The HRTO Process
An applicant files an HRTO application alleging discrimination or harassment under the Ontario Human Rights Code.
If the application proceeds, the respondent may be required to file a response according to the Tribunal’s instructions.
A reply or additional information may be permitted or required in some matters, depending on the response, Tribunal rules, and directions.
The HRTO may schedule mediation to help the parties explore possible resolution. The mediator does not decide the application, and settlement is not guaranteed.
The Tribunal may issue directions, request information, address jurisdictional or procedural issues, or manage the matter before a hearing.
If the matter proceeds to a hearing, an HRTO adjudicator considers the evidence and submissions and determines the issues before the Tribunal.
The Tribunal may issue a written decision. We can explain the decision and discuss next steps that may be available within the permitted paralegal scope.
